Sandra Bullock Facing Marriage Trouble in Texas

Rumors have been circulating through various sources that television personality Jesse James cheated on his wife Sandra Bullock. Sandra Bullock is an Oscar-winning actress for her film The Blind Side this year. With such allegations, Texas family law attorneys predict that there could be complicated legal matters if the couples decides to divorce.

NowPublic reports that the couple married in Santa Barbara, CA in 2005, but that the couple resides in Austin, Texas. Ms. Bullock owns two houses and two businesses in Texas, so she could easily file for a divorce in Texas even though the couple was married outside the Lone Star state. According to U.S. law, a married couple does not need to get divorced in the state in which they got married.

In Texas, adultery is considered a legitimate ground for filing a "fault" divorce. FindLaw states that a "fault" divorce means that one party is blaming the other for the failure of a marriage, versus a "no fault" divorce which implies that neither spouse did any wrongdoing in the marriage's failure. But what exactly is the advantage of filing a "fault" divorce?

Hypothetically, for Sandra Bullock, a fault divorce would mean that Mr. Jesse James cannot claim any of her assets. And considering Ms. Bullock was named one of the twenty richest women in entertainment with a net worth of $85 million, this can be a big deal. If Mr. James is put at fault for the divorce, she may not have to forfeit her claims to his assets. If Ms. Bullock does decide to divorce, she'll need a skilled Texas family law attorney to help with the division of martial property. Only time will tell if she will tell Jesse James to hit the road.
